have agreed as follows: ~ :
1. To forego foreclosure without pre judice to the fee
title holders, should the mortgage agreement subsequently fall
into foreclosure as regards the conditions of this Agreement.
2. IDITH L. BEAN has on this date paid taxes and assessments j
to date and has agreed to pay the taxies ~nd insurance pending this ~
Agreement with the right to annually charge the same back to the
sums payable by the Peters~hs. ~
3. JORDON P. PETERSEN and MARY H, PETERSDN promise and agree
to pay $85.00 per month beginning February 15th, 1970 and on each _
successive said date of each month after date until ~the whole sum
of $8,776.90 has been ~aid with interest C 72 per cent per annum
on all sums from time to time owing including taxes and insurance ,
subsequently paid, reserving to the Petersens the right of pre- G

payment witinout p~nalty. ~
4. That upon def ault of the Peters~ns for thYTty (30) days or ~

morE, EDITH L.~BEAN shall have the rights of foreclosure, including ~

l the right to accelerate the sums owed, costs of foreclosure and

~ reasonable attorney's f ees therein incurred.

~ 5. It is mutually agreed that the time of payments shall ~

~ be an essential part of the Agreement and all such shall be #
