FINAL JUDGMENT •
This cause having come on for hearing this day on plaintiff~s
motion for final judgment and motion to tax costs, and upon consideration
of the record, pleadings and proofs filed in this cause with said motion,
said proofs being the affidavits of James M. Moore, William H. Tylander
and 11Torabelle Wheeler on behalf of the plaintiff and an affidavit of the plaintiff, ~
the court finds that a default decree has been duly and regularly entered ~
i
against the defendant, Paul Tinney; and the court fu~ther finds that the
equities of this cause are with the plaintiff and that this court has juris-
j diction of the subjecft matterand parties hereto; that the allegations of
l
~
plaintiff~s complaint are true and have been proved by competent evidence;
tha~ the plaintiff has delivered to the defendant $2,136. 00 pursuant to the
terms of the agreement which is the subject matter of this suit; that the value
of the work performed by the defendant in initiation of construction of an
addition to the premises of the plaintiff is in the amount of $1, 200. 00; that
the defendant owes Tylander Lumber Co, and Wheeler Electric $182. 32 and
$56. 64 respectively for materials and labor used in construction of the afore-
~ said addition, and the Court being fully advised in the premises, it is
