This cause came on for hearing before me on plaintiff's motion
for summary judgment on Yay I, 1970 and the Court having considered
argument by counsel for the parties aud the entire record of t,his cause,
and it appearing to the Court that there is no genui.ne issue as to any material
fact and that plaintiff is entitled to a judgment as a matter of law, a~d the
Court being fully advised in the premises, it is thereupon

judgment be and the same is hereby granted; it is further
