Federa"1 and/or FPI shall have no obligation whatsoever to contribute f~r the initial installation of said Facilities, ; except, however, that Federal shall have the option to tie into the Facilities at such time as it so elects, the same being under- taken at Federal's sole cost and expense and without any additional ~ charge, ~ ~ D. The Interested Parties grant to one another,the right j , ~ to enter upon one another's land to undertake such installations and/or repairs to the Facilities that may be necessary or required. E. ~ach Interes ted Party agrees that prior to undertaking 1 any repairs to the FacilitieS except in extreme emergency, to notify all other parties of the necessity of making a repair to the Facilities. In the event an extreme emergency arises, then an Interested Party may undertake to commence the repairs and ~ s simultaneously therewith notify all other Interested Parties. ; F. The cost of maintaining the Facilities, that run from ~ ~ the lift station across Standard'sp~operty to FPI's property line - ; shall be borne equally by Kimco and Standard. However, in the event ; Federal elects to tie into the Facilities, then the cost of main- t taining the Facilities shall be borne equally by and between Standard, ~ Kimco and Federal. G. The cost of maintaining-the Facilities from the point of termination at Standard's property line across FPI's land to ~ _ Kimco's property shall be borne solely by Kimco. H. In the event any of the Interested Parties hereafter ceases to use the Facilities, then no further obligation for ttie cost of maintaining the Facilities shall accrue to that party, ~ However, at any time within one year from the date the party ceases ~ ~ to use the Facilities, it may elect to once again use the Facilities ~ ; provided, however, it undertakes all the obligations under the f terms of the agreement and any new obligations which a11 the other ~ Interested Parties have agreed to.
