N V ~ pB, t~o~~ - ~r ~ ~ IN ADDITION TO THE COVENANTS HEREINAFTER SET OUT THE MORTGAGEE AND MORTGAGORS COVENANT AND AGREE THAT: ~ (t) The MORTGACOR herein shall make within 7 days of the due date, the pnyments called for .in the lst mortgage now encumbe~ing this property, to the MORTGAGEE herein at its office or some other place as designated by the MORTGAGEE herein. j~ , (2) The MJ~TGAGOR herein shall pay within 30 days of the due date ail pertinent charges for fire and ! windstorm insuronce, ali ad valorem city and/or couMy taxes, any special improvement asseuments and any ~ other special governmenta4 assessments or charges. _ E (3) if the MORTGAGOR herein do not make the pay~nents on ihe 1St mortgage , the fire and windstorm insurance premiums and governmental taxes or special assessments as they come due, as well as the payments called for in this mortgage deed, then the MORTGAGEE herein can at its option make these payments, adding said paymenfs made to the balance due hereunder. If any one or all of the aforesaid payments remain unpaid for a period of 7 days or more, then the MORTGAGEE can atits option, without further notice declare the balance due under this mortgage due and payable in full at onoe and farthwith place the matter in the hands of sn attorney for ootiection or enforcement. In this event all - coits incurred will be chargeable to the bafance due under this mortgage• (4) The MORTGAGOR herein shall not further encumber this property exoept by obtaining WRITTEN per- mission of the MORTGAGEE herein end any attempt to do so without this written permission will be null - and void. (5) The MORTGAGOR herein will at the request of the MORTGAGEE herein, refinance the first mortgage _ - now encumbering this property at any time deemed desireble by the MORTGAGEE herein. The pro- ceeds of the. said refinancing shall be applied against the unpaid balance due I~ereunder. (6) The MORTGAGOR herein will be at the request. of the MORTGAGEE herein adcnowledge, in writing, the existence of this mortgage and the amouM still due thereon on a estoppel form provided for this pu~- pose by the MORTGAGEE . . Failure on the part of the MORTGAGOR to aomply with, perform, or abide by any of the agreements, stipulations, conditions a~d oovenants as set forth above in sections 1, 2, 3, 4, 5, 6, empowen the MORT- GAGEE herein, at his option, to declare the entire balanoe due hereunder, to be due and payable at onoe without notice. Failure of the MORTGAGEE herein to exercise this option at any time shall not oonstitute a waiver of the right to exercise this option at some later_ time. (8) The MORTGAGOR further agree t#~at this mortgege constitutes the entire contract befween the par- ties hereto, ~that they have read the provi:ions of this mortgaga and the note it securet and that fhey are aware of theic right to have ~fieir own attorney examine said mortgage together with the ssid note it secures and advise them as to it.
