TO WNOM IT MAY CONCERFI:
1. Section 21 of the Water Qua~ity Improvement Act of 1974, Public
Law 91-224, approved on 3 April 1970, requires that applicants for
Department of the Army permits provide a certificate from the aapro-
priate State or interstate water pollution control aqency to the
effect that there is reasonable assurance that the proposed activity
w111 be condusted in a manner which will not violate applicable water
quality standards.

l. It wiil accordingly be necessary that all applications for permits
received in this office on or after 4 l,~ril 1970 be accompanied by
the certificate mentioned unless in the ~udqment of the District
Engineer th~ nature of a proposed structure is such that in its
nornial and usual operation, no discharge into the navigable waters
would be involved. Rs general guidance only, the type of structures
which rvill be considered exempt from the requirement for a certificate
will include, but not be limited to, minar private pfers and docks, -
' private seawalls and bulkheads, grofns, mooring facilities, aerial
~ cables, and submerged cables and pfpes. Types nf w~ork requiring
' certf ficates wi 11 incl ude, but not be 1 imi ted Lo, carmierci al pi ers ,
docks or wharves, public fishing piers, platforms on which any type
of i ndustri al or carmet~ci al pl ant i s proposed , publ i c mari nas , any
dredging from the navigable waters or any dumping or filling therein,
and any outfall structure or outfall canal.
3. In the State of Florida the Department of Afr and Nater Pollution
Control, Suite 400, Tallahassee Bank Buildfng, 315 South Calhoun SLreet,
tallahassee, Florida 32301, is the proper agency to which requests
should be maide for Lhe required certificate.
