14. All of the easemcnts hcmby gr1ntcd are for the sole and
exclusive Uencfit of the p~rtics to whom the respective c:asemcnts are ~ranted
nnd their successors in ownership to their respective ~arcels of property in
St. Lucie and Indiln River counties, Florida, and the holders of the eascment
shall not have the right to convey the eascment or any rights granted by ease-

ment to ~any person except their successors in ownership to their respective ~
properties, All restrictions concerning the use of easements shall be deemed

and construed as restrictions running with the land. Any of the terms and ;

conditions, restrictions and odier provisions of the grant of each easement
may be altered, inodified, changed or rescinded by written agreement of all
of the holders of that respective easement as shown by the public records of
the county in wluch tlie property lies without th~ joinder or consent of any
other person. ;
15. Notwithstanding any of the prior provisions of this agreement
Radebau~h disclaims any knowledge of any of the representations contained in
paragraphs 3, 5, and 6 of this agreement.
16. Should Radebaugh request it, each of the parties who are the
owners of the parcels of property conveyed to Radebaugh described in para- .

~ graph 9 hereof do agree to execute and deliver to Radebaugh deeds conveying .

~ Tuerk and George Reynolds Tuerk, as Co-Executors of the Last Will and

~ Testament of Fred R. Tuerk, deceased, the owners of Parcels 1 and 2, and i

the other would be from Herbert J. Knudten and Sophia P. Knudten, his wife,
~ the owners of Parcels 3 and 4. In addition, the Drainage District will execute ;
~ and deliver to Radebau h a uit Claim Deed to all of tlie property described '

17. The parties hereto do further agree that they will cooperate ;

~ with each other and with all public officials and official bodies in order to i
