(b) To change the boundary lines of the Drainlge District
in order that the lands encompasseci within the Drainage District would not
include any of the lancls conveyed to Radebaugh described in Paragraph 9
hereof. Pending such change and because the lands described in Paragraph 9
hereof now ]ie outside of the perimeter dike which protects the lands of the
District lying within the perimeter dike and permits the Drainage District-to
provide drainage and irrigation according to its plan of reclamation, the
~ Drainage District agrees that it will not, unless compelled or required by
decree of a court of competent jurisdiction, levy any Drainage District taxes
on the lands described in Par~graph 9. ~
