ASSUMPTION A~REEMENT

of St. LuCie _ County, Florida, first parties, and FIRST FEDERAL
SAVIidGS AND IOAN ASSOCIATION Of FORT PIERCE, a corporation with main office in Fort Pierce, Florida,
second party, and ~ce R. Abernat~r and Andrea H. Abernatt~y, his irife
Third Parties.
WITNESSETH: That whereas, an November 26~ , i9 Third Parties be-
ing indebted to Second Party in the sum of 1~x_~0•~ did make, execute and deliver
unto Second Party a ce~tain promissory note and Mortgage Deed securing the same, said mortgage encumber-
ing property situate in St. LuCie County, Florida,
described as follows:
Lot 11, Block 2, GREEWOOD, as per plat thereof on file in Plat Book i1,
page !t1 , Public Records of St. L~icie County, Florida,
f.'
which rrwrtgage is of record in 0. R. g~~ 159 , pagels 58b-5a7 of the publit
records of St• LuCie County, Florida; and
WHEREAS, there is now unpaid on said promissory note , the principal sum of E~ 7~ ~ 3~1.62 _
together with interest from ~Ptembsr 10, , 14 70 , at the ra±e. of
6.75 96 per annum, and
WHEREAS, First Parties have purchased said property from Third Parties; subject to the fien of fhe afore-
said mortgage, and, as a part of the consideration for said property, the First Parties have assumed and agreed to
pay the indebtedness secvred by the aforesaid mortgage and to perform and comply wifh all covenants, obliga-
tions and agreernents by tfie mortgagors b be kept and performed under said mortgage; and Third Parties, iden-
tified as origi~al borwowers herein, have requested Seco~d Party to consent to such transfer of said property
and relieve Third Parties of responsibility for any deficienry decree in the event it becomes necessary to fore-
close said mortgage;
NOW, THEREFORE, in consideration af the sum of s25.00 in hand paid to Second Pa?ty, the receipt of
which is hereby acknowledged, and, in funher mnsideration of the agreement of Second Party te oonsent to
the aforesaid transfer, said consent being evidenced hereby, first Parties do hereby assume personal liability
for anc~ agree to pay the indebtedness secured by the aforesaid rtwrtgage at the times and in the manner specified
in the aforesaid mortgage and in the promissory note therein described, and do f~~ther agree to perform,
oomply with and abide by each and every stipulation, agreement, rnvenant and condition af said note and
mortgage. _
Seoond Perry herel~y covenants and agrees that it wil) nof seek a deficiency docxee against the Third
against the Third Parties in the event it becomes necessary to enforce the mortgage security, nor enter any suit
on the promissery note against the personal tesponsibility of Third Parties. ~
