MADE by the undersigned Developer, £or itself, its successors,
grantees and assi~ns.
The undersigned Developer, ST. LUCIE: COUNTY BANK, AS TRUSTEE,
under a certain Trust Agreement dated the 25th day of September, 1968,
and known as Trust No. 3, being the owner of fee simple title of record
to those certain lands located and situate in St. Lucie County, Florida,
being more particularly describ~d as follaws, to-wit:
Lots 6, 7, 8 and 9, Block 1 of BAY SHORE ESTATES, according to the
Plat thereof, as record~d in Plat Book 11, Page 40,-of the Public
Records of St. Lucie County, Florida,
does hereby submit the said ~ands and i.mprovements thereon to condominium
ownership pursuant tn tt:s-grovia~~ns of Chapter 711 of the Florida Statutes,
hereinafter called the "Condomir~ium Act", reserving the right to submit
additional lands to be described in an exhibit to be attached hereto by
appropriate amendment to condominium ownership in the future.
1. The name by which this condominium is to he identified is COL-
ONNADES CONDOMINIUMS NO. 1.
2. Definitio~ns. The terms used in this Declaratian and in its exhi-
bits, including the Articles ot Incorporation and By-Laws of COLONNADES
CONDOMINIUMS ASSOCIATION i~10. 1, INC, shall be defined in accordar?ce with
the provisions of Section 711.03 (Fla. Stat. 1963) of the Condominium
Act, and as follows unless the context otherwise requires: -
2.1 Apartment means unit as defined by the Condominium Act.
2.2 Apartment awner means unit awner as defined by the Condominium
Act. " ~ ~
2.3 Lessor means the owner of the Recreation Area unless the con-
text otherwise requires.
2.4 Association means COLONNADES CONDOMINIUMS NO. 1, INC, and its
successors.
2.5 Condominium unit awner means the awner of a condominium apart-
ment.
2.6 Common elements shall include: _
(a) All of those items stated in the Condominium Act.
(b) Tangible personal property required for the maintenance
~ and ope~ation of the Condominium, even though owned by the As-
sociation.
(c) All Condominium property not included in the apartments
or in the Recreation Area.
2.7 Recreation Area means those lands which are subject to and
more particularly described in a Ninety-Nine Year Lease which is at-
tached as an Exhibit E hereto, and such additional lands as may be
included within the purview of said le~se in the Future.
2.8 Comraon expenses include:
(a) Expenses of administration anc? management of the Asso-
ciation and of the Condominium property.
