HomeMy WebLinkAbout1513 • ~ ~~~~3': : MODIFICATION AGREEMENT THIS AGREEMENT made this 1$th day of September, 1970, by and between INTERSTATE HIGHWAY INVESTMENT CORPORATION, the owner of that certain property described in that certain instrument dated June 21, 1968, contained in O. R. W I T N E S S E T H That the said parties do hereby each for himself, his heirs, executors, administrators, successors or assigns do mutually agree that the terms of said mortgage shall be modified as fo2lows: Notwithstanding the terms and provisions of that certain mortgage dated June 21, 1968, contained in O. R. Book 172 at Page 2232 of the Public Records of St. Lucie County, Florida, a person, who has purchased a sub-divided portion of the encumbered property from the mortgagor. its successors or assigns, shall nevertheless be entitled to a full release by the mortgagee, his successars or assigns, from the lien and effect of said mortgage upon the sole and express condition that such purchasor has paid for the subdivided i property a minimum of Twelv~e Hundred ($1,200.00) Dollars per acre, his ~ purchase contract is pa~d in full, and the mortgagee has received from s the mortgagor, its successors or assigns, or from such purehasor, the sum of Eight Hundred ($800.00) Dollars per acre.
