This Leuse entered into tl~is day of ~~~u st- , A. D. 1970,
by a~ul betc~cen CITY OF FORT PIERCE, FLORIDA, party of the first part,
hereinafter referred to as "CITY", a~ul INDIAN RIVER MINERAL, INC. , a
Floridu carporation, party of the secorrd prxrt, hereinafter referred to as
"11~IINERAL", ~ ~

WITNESSETH:
Tliat far and in consitleration of tl:e sum of One (~l. 00) Dollar und
` otlie~r good and vuluabte conside•rations, CITY daes hereby tease, demise arui
let unto MINERAL upon the following terms urul conditions the privilege of run-
ning a line of cargo vessels ,j~ro~n CITY'S wharf located in the City of Fart
Fierce, Flm~ida, and more particularty described upon the drawing attached
l:ereto as Exhibit "A" and made a purt hereof, and MINERAL agrees to Zease
said wharf upon said terms and conditions as follows, to-wit:
1. This Zease shalt be for a teym of five (5) years from date hereof ~
with option to renew the same upon the terrns and conditions hereinafter set

` 2. MINERAL agrees to pay to CITY as rental for said demised pre-
rnises during ihe term of this lease the sum of Twent.y-Five Thousand
(,~25, 000. 00) Dolturs, which said s~cro shalt be payabte at the rate of Five
Thousa~ui ($5, 000. 00) Dollars per year in quarterly installment.s of One Thou-
sand T`cvo Hu~rdred Fifty ($1,250.00) Doltars payable in advance, the receipt of
the first such installment being hereby acknowledged.
3. ~1~llNERAL, as a material part of the consideration herein, hereby
waives atl claims ugainst CITY for damages to goods, wares arrd merchandise,
equip~nent urul shipping vessels in, upon or about said premises and for inj:rries
to persons in or about said premises from any cause arising.at any time and
.'VIINERAL shull hold CITY exempt ancl harmless ,~rom liability for any da»iuge
ar injury to uny person or to the goods, wares or mercha»dise of any person -
urising~ from the use of the /rremises by MINERAL or,~rom the Jailure of
