ing all of the above described property from the lien of said mortgage, .
upon the condition that such Partial Release ahall be recorded in the Pub-
lic Records of St. Lucie County, Florida upon there being paid over to
said Marcel Mauron the sum of ~100, 000. 00 cash. And
WHEREAS, the parties hereto have by mutual agreement agreed
that Sellers are to sell and Buyer is to buy only that part of the above de
scribed property legally described as follows, to-vvit:
: All that part of the E~ of Section 12, Townahip
34 South, Range 39 East lying North of the 'I~rn-
pike Feeder Road, and all that part .of the Vlf~ of -
Section 7, Township 34 Soutli, Range 40 East lying
North of said 1~rnpike Feeder Road: less 2. 9 acres
hereinabove described. ~
at and for a~cash purchase price of ~135, 000. 00, free and clear of any
and all liens or encumbrances. And
VIIHEREA~, the parties for their mutual protection and bene;fit
have reached certain agreements between themselves ~pertaining to the
said sales lietween them.
NOViT THEREF'ORE, in consideration of the premises, the mut-
ual covenants and conditi.ons hereinafter stated and the sum of Ten Dollar
and other good and valuable consideration in hand paid by each party to
~ the other, it is hereby cornracted and agreed as follows:

23, 1970 is hereby cancelled, rescinded and declared to be of no further
legal force or effect. Each party hereto hereby releases the other party
from any . and all legal liability or responsibility under said sales cornract
and all its several terms, conditions and covenaMs, specifically includ-
ing all terms and conditiona therein applica.ble to Sellers' remaining lands
~ lying -Southerly of the 'Itirnpike Feeder Road and lying Northerly of the
~ lands being actually conveyed to Buyer last described above. Said sales

contract shall be considered by the parties just as if it had never been
made and entered into between them.
