HomeMy WebLinkAbout0894 mobile home or residential purposes, that upon such subdivision or de- velopment that the owners thereof shall pay to the Buyer or to said Drainage District, if directed so to do, such amount as would equal the figure agreed upon in the original Drainage District agreement, that is, One and 50/100 Dollars (~1, 50) per acre, plus the drainage tax applied - to debt reduction, which is presently in the amount of eighty-six cents ($.86) per acre. The parties further agree that the Sellers obligation hereunder shall never exceed 'I~vo and 36/100 ($2. 36) Dollars an acre, but may be less. 'Ifie parties further agree that this obligation shall exist only so long as the Buyer, its grantees or assigns, are obl~gated under the Drainage District Agreement, and should such Agreement be cancelled or changed then the Sellers Shall have no obligation except such obligation. as may be a lower amount under said changes or modi- fications. Should the Buyer, its assigns, or grantees, be relieved of an obiigation under said Drainage Agreement, then the Sellers, their grante s. heirs, or assigns shall automatically be relieved of said portion of the obligation. It is further understood that the Sellers, their grantees, hei or assigns shall have no obligation under this clause until such time as the land is either subdivided or developed, and then shall be liable only to the extent of said subdivision or development figured on a acreage ; ~asis. The parties hereto further agree that in the event litigation re- I l ~ sults from this clause to seek an interpretation or enforcement ~thereof, ~ that the prevailing party shall be entitled to all costs, including a reas- onable attorney's fees. ~ 6.
