of Feceivers in like cases, and such appointment shall be r.~de
by such Court as a matter of strict right to the Lessor, arxl
without reference to the adequacy or inadequacy o~ the value
of the property which is sub~ect to the Lancllord's lien, or to
the solvency or insolvency of the Lessee, and without :°eference
•to the commission oP waste.

26. Costs and Attorneyts Fees. In any proceeciing arising by ;
reason of an a ege a ure o e Lessee to ~erform any o~ its nu-
ties and obligations pursuant to the provisions herzof, or by :ezson
of an alledged breach of any oP the terms and/or corxiitions or cove-
nants of this Lease, or by reason o~ any default in the :oayment of ar~r
monies, rentals or suras due or becoming due under the terrr.s ar•d provi-
, sions hereof, or by reason of any action by the Lessor to require the
Lessee to comp]y with ii.s duties and obligations hereunder, the Lessor
~ shall, in the event it~shall prevail in such action, be entitied to re- #
cover its reasonable attorney's fees incurred, together with all costs, ~
' including those not normally al'?owable in actions a~ laV~, such as but
not limited to copies o~ de~oosi~ions, whether or not use~ at tri~i;
travel expenses for witn~sses traveling from without St. iucie Cou:~ty '
for the purpose of testifying at trial or deposition; exp2r~ witness
fees for testifyir~g at trial or deposition, to~ether with such addi-
tional fees as the expert witness may charge t:~e L-essor in connection
with his preparation for giving such testimony; and t~ritness su'opoenas
issued to insure the presence of vritnesses at deposition or at trial
whether or not the witness shall ac~ualiy appear to be called upon to
, testify. In the event of ar~y dispute or litigation be~ween tr.e Lessor
and the Lessee in connection with any alledged breacn or default u~a:r
; the part of the Lessee whe-rein the I,essor deems it advisable or neces~
; sary to retain the services oi an attorney, and which is se~tled prior
~ to a~udicial determination of the issues, or prior to litigation, by ~
the Lessee payin~ the ~ monies demanded, or by the Lessee other~rise co:n- ~
plying with the demands of t:~e I~essor as to the i.essee's du~~ies and
.obligations under the terms of this Lease, the Lessor will be deen~ecl
to have p~evailed in such dispute or controversy, and to be entitlen

tion therewith.
