Lessee shall comply with the above provision with regard to notice ar~d
inforc~ation to the Lessor, t:~~n the right of the L2ssor to termin~te
by reason of the provisions of ~his section shall be controlled by the ~
outcome o~ such liti~ation, towit:
a. If such litigation be rzsolved in favor of the Lessee, ~
the Lessor shall have no right tio terminate by reason of tne ~
occurrence of the acts above listed.
b. If such litigation be resolved a~ainst the s.,essee, the
Lessor shall have tne rignt to ~ermina~e as above p~o~~ided, but
. nothing herein shall be construed 2s relievin5 the Lessee of the
- performance of ar~y of its covenants her~ein which becar~~e per~ orm-
. able prior to the determination of the outcorr.e of such litigation
. or the earlier abandonment of defense by the Lessee.
, 28. Lntire Agraement. This instrument cons~i~utes~ t:~e entire
agreement e waen L e par ies, and neither partf has been inducen 'oy
~ the other by representations, promises or understandings not expressen
herein, and there are no collateral agreements, stipulati.ons, promises
_ or understandin~s whatsoever in any way touching the sub~ect matter oF~
this Agree~r,ent which are not expressl,y contained herein.
I 29. Notice. Whenever, under the terms of this Lease agreement,

m~e to the giving of notice by one of ~he par~ies here~o
to the other, or whenever either of the parties shall desire to Sive -
notice of ar~y matter to the other, such notice shall be given and shall
.be deemed sufficient when given by written instrument sent by regis-
tered or certitied mail, return receipt requested,_addressed ~o the ap-

~ phrase or word, or o~ any~ vrovision of this Lease, shall not affect the
