I~ZODIFICATION OF` NiOR'PGAGE ~
THIS AGREEMENT, entered into this, the 17th day of
l~ovember ~ , A. D. 1970, by and between SUNSWEET GROVES, INC. ,
a Florida corporation, Party of the First Part, and JACQUELINE H. CARLTON
REMMERSWAAL, a free dealer, Party of the Second Part;
WITNESSETH:
WHEREAS, the Party of the Second Part represents and warrants that
she is the holder and owner of a certain promissory note and mortgage securing :
the same, and the Party of the First Part represents and warrants that it is the
owner of the equity of redem~xion of the mortgaged premises; and ~

WHEREAS, that certain mortgage securea a promissary note which is
described as follaws: . ~

Promissory note in the face amo~t of $214, 000. 00, executed by ~
joseph M. Propst, as Trustee, dated December 12, 1961, a cc~y
of which is recorded in that certain mortgage dated December 12,
1961, executed by the said Joseph M. Propst, as Trustee~ to
jacqueline H. Carlton Remmerswaal, a free dea~er, and recorded
in Official Record Book 25, page 46, public records of St. Lucie
Coumty, Florida, on December 12, 1961, which said mortgage

secured said promissory note; _

~ WHEREAS, said promissory note and mortgage was executed by Joseph -

M. Propst, as Trustee, and the title to the mortgaged premises has been
~ transferred to the said SUNSWEET GROVES, INC. , a Florida corporation; and
WHEREAS, the parties are desirous of a modification of the terms of
~ payment of the promissory note contained in said mortgage.
~ NOW, THEREFORE, THIS AGREEMENT, WITNESSETH: That in con-

~ aideration of the premises and in further consideration of the mutual covenante
~ and agreement~ herein contained between the parties hereto, each party agrees
for itself, ite heirs, repreaernatives, succesaors and assigne, that the terms
oi the promiesory note are modified and changed as 'follaws:
