HomeMy WebLinkAbout2151 18 'Tb~e term "Sinlting Fund Certificate for Series N bonds" as used in this SecHon and elsewhere in the Indenture shall mean a oertificate filed by . the Company with the 1~ust~ee pwrsuant to this Section, sigped by the Presideat or a Vice President of the Company and a p=acticing aa~unt- ant (who shall be appoint~ed by tLe Boazd of Directors and be satisfactory ~ bo the 1'~rustoe). On or before the first day o# November in each of the years 197I-9000, both inclusive, so long as any bonds of Series N are outstanding under the Indenture, and if the payment is to be made in other tLan c~ssh, the Company shall deliver to the Tivstee a Sinking Fund Certificafie for Series N bonds showing the sinldng fund payment for that year and the manne~r in which the Company elec~s to satisfy sucL sinldng fund PaY- _ meat The Company shall concurrently with tLe delivery to tLe ~n~stee o# such oertificat+e, deliver to the Trustee the cash, bonds and certificates . ~y ~ ~g ~a ~ym~t ~ r~ m~ ~a by . c~ c~~y. - Bonds of Se~ies N to be redeemed for sinldng fund purposes sbaIl be - redeemed in aocardance with the provisions of Article IX of the Original Indeahu+e. - ~ AnY ~g fund c~sh remaining with the Tnistee after any such re- ~ a~,P~ ~ t~g ~ ~~a ~ ~u ~~ue ~ be beld m trust by the Trustee. Until there shall have been the further ~ aeposit of simldng fund cash with tbe Tivstee, such eace~ cash may be used by the Tmstee to purchase in tLe open market at the direction of the Company bonds of Series N at a price not greaber than the prlncipal amount thereof aud acciued interest at #he date of purcbase. Any such ~coess c~.sh remaining on deposit witL tLe Trustee at the time of a subso- queat deposit of sin1~?g fund c~sh with the Trustee s~all be e~hausted insofar as possible for tLe redemption of Series N bonds ~xususnt to this Se~tio~.
