STATE OF FLORIDA ) COUNTY OF ST. LUCIE ) Before me, the undersigned authority, personally appeared WALLACE SAMPLE who, upon first being duly sworn, did depose and say that he has re- sided in St. Lucie County, Florida, for 58 years last past and is currently one of the Circuit Judges of the Nineteenth Judicial Circuit of Florida and has served in such capacity since 195 9; that this affiant was admitted to the Bar of the State of Florida in 193? and practiced 2aw cor~tinuously in St. Lucie ~ County, Florida, thereafter until being commissioned as Circuit Judge. That as an active practioner , this affiant numbered among his clients G. Albert Bloodworth, Lillie O. Bloodworth, J. Logan Bloodworth and G. Ernest Bloodworth and as counsel for those members of the Bloodaorth . family was familiar with the Deed Agreement and Trust Agreement first above described and which are the subject of this affidavit; that as shown by the official recorder's stamp, said documents were filed simultaneously at 10:47 A. M. on August 14, 195? and merely thx~ough inadvertence, the Trust Agreement was first entered upon the public records under C2erk File Number 59647 with the Deed Agreement being entered under Clerk File Number 59648; that notwithgtanding the transposition in filing order, the only reasoning by which one can give full effect to the intentment of the parties, and which this affiant knows to have been the intent of the parties, would be to give first effect to the Agreement of Deed and thereafter give effect to the Trust Agreement. ~ eocK1~? ~accZ322 - - 3 < -r - ~~-.x1~ r : n`"` f ~~s~~~~~"'~~..~_ ` ~
