BEFORE ME, the undersigned authority, personally appeared
GEORGE W~ MOOR who, uQon first being duly sworn, did depose and say
that he is Vice-President and Trust Officer~of First National Bank of Fort
Pierce, a national banking corporation having Trust Powers, und makes
this affidavit relative to the date of the Trust Agreement under which said _
Bank, as Trustee, received title to the lands described in Trustee's Deed
of record in Official Record Book 188, at page 1554 of the public records of
St, Lucie County, Florida, for and on behalf of the named grantee Trustee
and hi.mself.
This affiant says that as Trust Officer of said First National Bank
of Fort Pierce he is charged with the custodianship of said bank's Trust
Agreements, and having thi$ day personally examined said bank's counter
part of the written agreement comprehending Trust #2, this affiant finds that
said Trust Agreement, in truth and in fact bears date of November 17, 1970
while the Notary Public's Certificate of Acknowledgement thereun to appended
bears date of November 24th, 1970. ~
Affiant further says that said bank as Trustee received the titles
to the real properties more particularly described in deed recorded in O.
R. Book 188 at page 1554 in the identical trust capacity , i, e. , as Trustee
under Trust ~2, as said bank, as Trustee, executed its mortgage, and
promissory note thereby secured, unto First Federal Savings and Loan
Association of Fort Pierce bearing date of November 25, 1970, securing
$161, 300.00, and which is of record in O. R. Book 188, at page 1960 of
the public records of St. Lucie County, Florida.
~ This affiant further says that notwithstanding the scrivener's error
~ as to date of the Trust Agreement by which the grantee is described in the
~ deed of record in O. R. Book 188, page 1554, the said First National Bank
; of Fort Pierce received said titles as Trustee under a Trust which is
~ correctly described as being "under Trust Agreement dated the 17th day
of Navember, 1970, and known as Trust #2".
