and
WHEREAS, second party has a-right of Hrst refusal to pur-
chase an a,dditional 323 acres lying northerly of said 188 acres, described
as:

Range 39 East
and
WHEREAS, most of the above described property now owned
by second party and on which it has a right of first refusal to purchase
was at one time within the boundaries of the Fort Pierce Farms Drainage
District but was removed therefrom by Decree of the Circuit Court of
St Lucie County, Florida pursuant to Agreement between Fort Pierce ?
Farms Drainage District and the then owners of such lands dated August
30, 1945 and recorded in Deed Book 118, Page 522 of the Public Records
of S~ Lucie County, Florida; under which agreement the waters falling
upon such lands was permitted to flow from said lands intio the drainage
system mainta.ined by first party; and .
VIIHEREAS, second party intends to develop its hereinabove de-
i scribed property into a mobile home park or similar residential type de-

} velopment and will canstruct, operate and mainta.in in connection therewi
a sewer~ treatment plant, water treatment plant, storm drains and other
appurtenances usual and customary in similar type residential develop-
~ ments, ~ and will require for such development adequate drainage of sur-
face waters, waters discharged from mobile homes or residences and
treated effluent from its said treatment plants. And
' ~ WHEREAS, the adequate drainage requirements required by
second party could nat be met under the said existing Agreement dated
~ August 30, 1945 and recorded in Deed Book 118, Page 522 of the Public
Records af St. Lucie County, Florida as the same providea for the dis-
charge only of water which falls upon second party's said lands irito the
