And WHEREAS, there is in existance a canal lying oontiguous ~o the West boundary of the above described property owned by 8econd party and said property upon which it has a right of Hrst refusal to purchase, which is a Northerly extension of Canal No. 3 owned by 8rst party and within its boundaries, described as: . The West 4 feet of the East Half of Sections 1 and 12, Township 34 South, Range 39 East and the West 4 feet of that part of the East Half of Section 13, Township 34 South, Range 39 East lying North of the North boundary of . Fort Pierce Farms Drainage District in said Section 13, Township 34 South, Range 39 East. AND the East 55 feet of the West half of section 1, Township 34 South, Range 39 East, the East 66 feet of the VlTest half of Section 12, Township 34 South, Range 39 East and that part of the East 70 feet of the VUeat half of Section 13, Township - ~ 34 South, Range 39 East, lying . North of the North boundary of Fort Pierce Farms Drainage in said section 13, Township 34 South, Range 39 East. All of which canal is presently without the boundaries of Fort Pierce Farms Drainage District, and no part of which canal is maintained by first party. - AND WHEREAS, second party has requested first party to allow it ~ to drain all said lands owned by it and on which it has said right of first ~ . refusal to purchase on an unrestricted basis through the above described ~ ~ canal into the drainage system operated and maintained by first party ~ - ~ within its boundaries; which request has been granted by first party upon certain terms, condftions and the consideration hereinafter stipulated.
