sum and the incerest ther~on shall conetitute a lien upon all of second
party's said lands inferior only to ad valorem taxea legally levied and
assessed against said lands; that if the annual sum due first party from
second party, plus accrued intereat, is not paid within 60 days after the
same becomes delinquent on April 1 st, as hereinabove provided, Hrst
party shall have the right to enforce the payment of said sums through
the foreclosure of its said lien against said lands now owned by second
party or acquired by it under its said right of first refusal to purchase, ~
in which event the pleadings, process, proceedings, practice and sale
shall~ be the same as in an action for the enforcement and foreclosure of
mortgage upon real estate; that in the event of a foreclosure of said lien, .
said party of the second part, for itself, its successors, legal repre-
sentatives and asaigns, agree to pay all and singular the costs, charges
and expenses, including reasonable attorney's fees and court costs incurr
or paid by said first party in said foreclosure.
6. This Agreement shall be binding upon all of the herein-
above described lands owned by second party and .shall be and consritute
a covenant running with the land, and this Agreemern shall be binding upo
the parties hereto and upon their respective successors, legal represen-
tadves, grantees and assigns in perpetuity unless cancelled by recordable
~ instrument in writing entered into between both parties.
