HomeMy WebLinkAbout1837 e to the number of persons who may use the Recreation Center under s other leases. . _ The use, occupancy and poasession of the ~ Recreation Center by any and all of such other lessees shall be in recognition and co-extensive with the rights of this Lessee under this lease and other lessees under other leases so that the burden of this Lessee in keeping and perfonaing its aqreements herein made shall not be increased except as a greater use of the Recreation Center by reason of a qreater number of lessees in possession may~inevitably and nnavoidably require. a 3.2. Acts of Other Lessees. No default by any other ` Lessee in the performance of any of the aqreements contained therein nor any other act of omission or commission by any other Lessee - shall be construed or considered as a breach by the Lessor of any of its agreements contained herein, or as an actual, implied or con- structive eviction of the Lessee from the Recreation Center by the Lessor or anyone actfnq by, throuqh, under or for it; or as an excuse, justification, waiver or indulgence by the Lessor to the Lessee of the Lessee's prompt, full, complete and continuous per- fonaance of its agreements contained herein. ~ - i 4. USE OF PREMISES. t ~ . t 4.1. Intention. The Lessee has entered into this lease ~ to make available, on a nonexclusive basis, the demised premises for the recreation, leisure time activity, use, benefit and enjoy- ~ ment of the unit owners of Windmill Village By The.Sea Condominium No. 1. 4.2. Right to Use.
