WARRANTY DEED

THIS WARRANTY DESD, made the~day of January, 1971,
by JOHN S. CEMER and CHARLOTTB ANN C~~ his wife, hereinafter
called the Grantor, to ELMBR E. O'DELI~/ d~ROSELLA S. O'DELL, his
wife, whoae post office address is: 702 South Ocean Drive, Fort
Pierce, Florida 33450, hereinafter called the Grantee:
(Wherever used herein the tenas "grantor" and "grantee"
shall include all the parties to this instrwaent and the
heirs, leqal representatives and assigns of individuals,
and the successors and assigns of corporations.)
WITNESSETH:~ That the Grantor, for and in consideration
of the sum of $10.00, and other valuable considerations, receipt
whereof is~hereby acknowledged, hereby grants, bargains, sells,
aliens, remises, releases, conveys and confirms unto the Grantee,
all that certain land situate in St. Lucie County, Florida, to
wit:
West 1/2 of Lot 1, West 1/2 of Lot 2, West 1/2 of Lot
3, and the West 1/2 of Lot 4, all lying and beinq in
Block 2, WESTWOOD SUBDIVISION, as per plat thereof on
file in Plat Book 6, at page 17, of the public re-
. cords of St. Lucie County, Florida.
This deed is qiven with the express understanding that
the property herein shall not be used by Grantees,
their heirs or assiqns, at any time for the purposes
of a~doq kennel, veterinarian hospital, or to
operate a bar (including social and fraternal clubs ~
or organizations which permit bars) under the liquor
laws of Florida, unless permission for any of these
enumerated uses is first obtained from the Soard of
County Commissioners of St. Lucie County, Florida. /
SUHJECT to that certain mortgage from Grantors herein ~
to First Federal Savings & Loan Association of Fort 14~`=
Pierce, dated May 12, 1969, in the oriqinal principal j,~- ~
amount of $9,000.00, recorded in Official Record Book t{"~
177, paqe 1488, public records of St. Lucie County, ~ ~
Florida, the unpaid balance in the amount of $8,387.72 }
Grantees herein specifically assume and aqree to pay.
TOGETIiER, with all the tenements, hereditaments and ap- ~
purtenances thereto belonqinq or in anywise appertaininq.
AND the Grantor hereby covenants with said Grantee that
the Grantor is lawfully seized of said land in fee simple; that
the Grantor has good riqht and lawful authority to sell and con- j
vey said land; tha~, the Grantor hereby fully warranta the title
to said land and will defend the same aqainst the lawful claims
of all persons whomsoever; and that said land is free of all
encumbrances, except taxes accruinq subsequent to December 31,
1970.
