as the Grantors, and ST. LUCTE COUNTY, Post Office Box 700, Fort
Pierce, Florida, as the Grantee.
WITNESSETH: That the Grantors, in consideration of the sum of
One Dollar and other valuable consideratioris paid, the receipt of
which is hereby acknowledged, hereby grant unto the Grantee, its suc-
cessors and assigns, a perpetual easement and right of way for the ~~e
purpose of clearing, excavating, constructing and maintaining outfall
and drainage ditches and drains in, upon and through the following
described land in St. Lucie County, Florida, to-wit:
'Ihe Westerly 50 feet of the following described property;
'Itie S 1/2 of the N 1/2 of Lot S as shown on the plat of the Subdivision
of Russell's Land, recorded in Chancery Order Book 2, page ZZ4, '
records of Brevard County, Florida, lying and being in Section 28,
Township 34 South, Range 40 East.
'Il~e grantee agrees that the above described property will not be used
for public road purposes ~ without the written consenf of the grantor,
and the use of the property will be confined to excavating and ma~.n-
taining a ditch and other allied drainage and mosquito control purposes .
'I7~e grantor reserves the right to u~e said property; except, that no
structure or plantings of a permanent nature are placed thereon that
would in any way hinder the use of the property for its intended pur-
posc: and shall have the right to cross said property with a road or
crossing after installation of a culvert of the proper size and elevation.
. Any violation of the terms herein set forth shall void this easement ,
and the title of the property shall revert to the grantors, their heirs ~
successors, or assigns.
