Failure of a dwelling unit ownen to c~mpiy wi~h such document~ and regu- '
lations shall entitle the Association or other dwellin~ unit owners to
the following relief in additien to the remedies provided by the Con-
d~miniun Act: .
A. NFGLIGENCE. A dwellin~ unit owner shall be liable for
the expense of any maintenance, repair or replacement renderAd necess-

ar~- by his ne~li~ence or by that of any member of his family or his ~
or their guests, employees, agents or lessees, but only to tr,e extent
that such expense is nct. met by the proceeds of insurance carried by !
*he Associati~n. A dwelling u:.it owner shall pay the Association the
amount of any increase in its insurance premiums occasioned by use,
misuse, occupancy or abandor.ment of a dwellin~ unit or its appurtenances,
or of the ccmmon elements, by the dwelling unit owner.

because af an al~e~ed failure of a dwelling unit owner or the Associa-
tien ~o cemply with the terms of the L~eclaration, Artieles of Incorpora-
tion cf the Associaticn, the B~r-T,aws, or the regulations adopted pur-
suant tc traem, and the docLUrents and re~ulations as they may be amended
from time tc ~ime, the prevailing parLy shail be entitled to recover the

costs of tr.e proceeding and sucr. reasonabl~ attorney's fees as may be
awarded by the Court.
P~C WAIVER ~F RIGHT~. The failure of the Association or
