MORTGAGE OF REAL AND PERSOI~IL PROPERTY
THIS MORTGAGE, made this day of February, 1971, between ALBERT W.
JO~-II~iSON, joined by MARGARET H. JOHI~ISON, his wife, (hereinafter called
"Borrower"), Mortgagor, and W. Ashley Verlander, Judson S. Whorton,
George D. Auchter, Jr., Roqer L. Main, Brice R. Smith, Jr., and Charles
K. Cross, not individually, but as Trustees of AMERICAN CENTURY MORTGAGE
INVESTORS, a Massachusetts Busiriess Trust under Declaraticn of Trust dated
~tay 14, 1969, as amended, and their respective successor Trustees under
said Declaration of Trust (in the event of death, resignation or removal
of any Trustee herein named or the failure of any Trustee to be reelected,
any such Trustee shall automatically be divested of his interest herein,
and the remaining Trustees and any newly elected or appointed Trustee or
Trustees acting at the time shall be the sole vwners of this mortqage) with
pawer to protect, manage, sell, transfer, assign, consolidate, coordinate
and/or spread with any other mortgage, modify, satisfy, enforce, foreclose
and/or without being limited by any of the foregoing, deal with in any man-
ner, this mortgage and the lien thereof, and exercise any right or option
contained in this mortgage and to release any portion of the security from
the lien of this mortgage, and with power to sell, contract to sell, con-
vey, lease, encumber, execute deeds of conveyance, leases or mortgages
and notes in connection with or iri any manner and without being limited by
any of the foregoing, deal with the property described herein or any part
~hereof hereafter acquired by foreclosure of this mortgage or acquired in
any other manner (h~reinafter called "Lender"), Mortgagee;
WITNESSETH:

wHEREAS, "Borrawer" is justly iridebted to "Lender" in the principal sum of
ONE MILLION THREE HUNDRED EIGI~Y-FIVE THOUSAND AND NO/100 DOLLARS ~
($1,385,000.00), as evidenced by a certain promissory note of even date here - ~
' with, according to its terms, the final payment of which is due on March 1, ;
t ?572, executed by "Borrawer" and delivered to "Lender", and by reference ~
~ ~eing made a part hereof to the same extent as though set out in full herein; ~
~ NOW, THIS INDENTURE WITNESSETH: To secure the performance and observance by ~
~ the "Borrower" of all the covenants and conditions in the note and in this
s mortgage contained, and in order to charge the properties, interests and
` rights hereinafter described with such payment, performance and observance,

~ and for and in cons ideration of the sum of One Dollar ($1.00), lawful money
~ of the United States of America, to the "Borrawer", duly paid by the "Lender"
; on or before the ensealment and delivery of this mortgage, and for other val-

~ uable considerations, the receipt whereof is hereby acknawledged, the "Bor-
~ rower" has executed and delivered this mortgage and has granted, bargained,
~ sold, aliened, remised, released, conveyed, assigned, transferred, mortgaged,
; h~pothecated, pledged, delivered, set over, warranted and confirmed, and by
~ these presents dces hereby grant, bargain, sell, alien, remise, release, con-

~ vey, assign, transfer, mortqage, hypothecate, pledge, deliver, set over, war-
~ rant and confirm unto the "Lender" and its successors and assigns forever, all
~ of the follawing descri.bed land, real estate, buildings, improvements, fix-

~ tures, furniture, and other personal property (which together with any addi-
~ tional such property hereafter acquired by the "Borrawer" and subject to the
_ lien of this mortgage or intended to be so, as the same may from time to time
= constitute, is hereinafter sometimes referred to as the Mortgaged Property), ~
