EASEMENT
By this agreement dated this 17th day of March,
1971, MODULAR HOMES OF FLORIDA, INC., a Florida corpora-
tion, the grantor, does hereby grant, convey, release and
relinquish unto FORT PIERCE FIELDS PLAZA, a~oint venture
composed of MELVIN F. SENBLER, FRED A. BESHARA, ALBERT L.
DANGLER and NICHOLAS MANOS, the grantees, their heirs and
assigns, a non-exclusive right and easement appurtenant
for drainage purposes, including the right to construct and
maintain drainage facilities over, under and upon the real
property described in Exhibit A attached hereto and incorpo-
rated herein.
This easement granted hereby is intended to
be and shall be for the benefit of and as an easemeni
appurtenant to the real proper,ty described in Exhibit B
attached hereto and incorporated herein or any portion
thereof. The grantor reserves the right to make any and
all use of such easement for drainage purposes for itself and
its grantees and assigns. The easement granted hereby is
intended to and shall run with the real property heretofore
described.
In consideration whereof, the grantees hereby
covenant and agree that in the event the grantor constructs
a railroad spur track over the easement property described
in Exhibit A, the grantees shall reimburse the grantor for
the construction costs of a load-bearing drainage culvert
under said spur track at a cost not to exceed $1,200.00, and
the grantor covenants and agrees that such spur track shall
in no way interfere with the grantees' free use of the ease-
ment .
