And the parties of the second part further covenant ~
and agree as follows: ~
1, To pay all taxes, assessments, or impositions that ~

may be legally levied or imposed upon said land subsequent to the 31 st ~

day of December 1970. ~

2. To allow no liens to be placed on the above de- ;
: scribed property for materials furnished, or labor performed thereon, ~
;
and if any such liens are so placed, the same may be paid by tlie parties ;

' of the iirst part and each such payment, plus interest thereon at 9~ per ;

annum, shall be added to the unpaid balance of this Agreement. To
promptly pay for all labor performed and materials furnished upon the ;
` above property. '
3. To pay a reasonable attorney's fee and all Court
costs should the party of the first part be forced to take legal action to
~ enforce the pro~-isions hereof, or should the parties of the second part
breach this Agreement and refuse to quit the premises, making it nec- :
essary to bring eviction proceedings against them, or should the party of ;
the first part be required to foreciose this agreement or otherwise bring ;
~ legal action hereunder.
4. To promptly pay each and every installment here- ,
under as the same becomes due, rime of payments being of the essence.
5. The parties of the second part are execuring simul-
taneously with this Articles of Agreement, a Quit Claim Deed re-convey-
ing the above described property unto the party of the first part, with
the express understandingthat so Iong as the payments called for here-
under are promptly made, and the second parties otherwise abide by ali
the other terms hereof, the said Quit Claim Deed shall be held in escrow.
However, should any payment called for hereunder remain unpaid for 60
days from the due date or should second parties otherwise breach this
contract by non-payment of taxes or other covenants herein contained then,
- first party may, without any notice or demand to second parties record
said Quit Claim Deed and there upon second parties shall have no further
right, title, interest, claim or demand to the above described property
and first party may re-take possession of the same instarner and second
