HomeMy WebLinkAbout1323 TOGETHER with all of the right, title and interest of grantors in and to the St. Lucie Mutual Water Company, a non-profit cooperative association under the laws of the State of Florida insofar as the same is applicable to the real property herein described and conveyed; also TOGETHER with all fixtures, chattels, and articles of personal property placed upon or attached to or used in connection with or in the operation of such premises, or which ~ may hereafter be attached to or used in connection with such premises, and all the tenements, hereditaments and appurtenances thereto belonging or in anywise appertaining. SUBJECT TO the lien of a mortgage from KDI Electro-Tec Corp. to The First National Bank of Cincinnati, as Agent for ten banks including itself, dated October 27, 1970, and recorded in Book 189, Page 1441 of the Volusia County, Florida mortgage records. To have and to hold the same, together with the tenements, hereditaments and appurtenances, unto the said mortgagee, and its successors and assigns, in fee simple. And the mortgagor hereby covenants with said mortgagee that it is lawfully seized of said land in fee simple; that it has good right and lawful authority to sell and convey said land; that it hereby fully warrants the title to said land and will defend the same against the lawful claims of all persons whomsoever; and that said land is free of all encumbrances except as noted above. Provided always, that if said mortgagor, its successors or assigns, shall pay unto said mortgagee, its successors and assigns, all indebtedness represented by said notes payable or if KDI Corporation shall pay unto said mortgagee all indebtedness represented by said Certificates of Indebtedness and sha21 perform, comply with, and abide by each and every of the stipulations, agreements, conditions and covenants set forth in said Certificates of Indebtedness, then this Deed and the Estate hereby created shall cease and be null and void. While this mortgage remains unreleased of record, it shall ; also secure the payment of any additional notes payable given by the mortgagor in exchange for loan advances from KDI CorFo- ration, which notes payable are then pledged with the mortgagee ~i~~.
