HomeMy WebLinkAbout1884 ~ i 1 ~ ~ ~ ~ 5. Section XVII, MISCELLANEOUS PROVISIONS, Subsection E, shall read in its entirety as follows: "XVII. "MISCELLANEOYJS PROVISIONS "In the event that any taxing authority shall assess ad valorem taxes on a condominium unit (the individual lot together with the lot owner's undivided interest in the common elements), the Association will not assess the member for real or personal property tax assessed ~ ; against the condominium project nor will the Association ~ maintain the escrow account for payment of same as set forth in subparagraph "A" hereof. Nothing herein shall be construed, however, as giving to any unit owner the right of contribution or any right of adjustment against any other unit owner on account of any deviation by the taxing authorities for the valuations herein prescribed, each unit owner to pay such ad valorem taxes and special assessments as are separately assessed against his "con- dominium parcel" as set out het~snabove. "For the purposes of ad valorem taxation, the ~ : interest of the owner of a"condominium parcel" in his ~ "condominium unit" and in the "common elements" shall , be copsidered as a unit. Th e value of said unit shall ~ ; i be equal to the percentage of the value of the entire ~ , ~ condominium, including land and improvements as has ! been assigned to said unit and as set forth in this i Declaration. The total of all of said percentages ~ equals 100% of the value of all of the land and improve- ~ ments." 5 ~ i ~ 6. Section?~JII, MISCELLANEOUS PROVISIONS, Subsection J, shall ~ ~ read in its entirety as follows: ' i ~ i a "XVII. ~ MISCELLANEOUS PROVISIONS ~ "The Association, as Lessee, has entered into a long- term lease (fifty years) with the Developer described in . Exhibit "E" attached hereto and made a part hereof. The - Developer has constructed or has agreed to construct recreational facilities consisting of a swimming pool and cabana club on the demised premises, subject to the terms of the said long-term lease.
