THIS INDENTURE, made this 13th day of July, A.D.,
197I, between
BEIt~ KAPLE
of the Co~.~nty of Fulton in the State of Georgia, party of the first
part, and
RALP~: C . J ENKINS
of the County of Cherokee in ~he St~te of Georgia, party of the second
part, whose post office address is Route #1, Canton, Georgia 30114,
W I T N E S S E T H•
That the said party of the first part, for and in considera-
tion of ~he sum of TEN DOLLARS ($10.00) and other valuable considera-
tions to him in hand paid by the said party of the second Fart, the
receipt whereof is hereby acknowledged, has granted, bargained and
sold to the said party of the second part, his heirs and assigns
forever, the following descr~bed land, situate, lying and being in
the County of St. Lucie, State ot Florida, to-wit:
Lots 1 and 2 of Block 8 of Surfside Plaza, Unit ~1, as
per plat thereof o~ fi~e in Plat Book 5 at Page 46 of
the Public Records of St. Lucie County, Florida.
~ubject to al~ State, County and City taxes subsequent
to 1970. '

' The party of the second part, his heirs, executors, ad-
ministrators, and assig,ns hereby covenants with the party
of the first part: his heirs, successors, and assigns that ~_~G
any building that ~nay be erected on the above described i'~
land shall not be used otherwise than as a private dwelling
house including a garage in addition thereto and no dwell-
ing house shall be erected on said land that will cost less
than Thirty-five Hundred Dollars ($3500.00).
And the said party of the fir"st~part does hereby fully
warrant the title to said land, and will defend the same against
the lawful claims of aIl persons whomsoever.
