purchasers of adjoining units or by their successors in title. «'tien~
ever any such wall, or any ~art thereof shall be erected inhe sanle
manner at the same location at which it was initially constructed~ and
stiall be of tl~e same size and of the same or similar materials and of
like quality, applicable ordina:.ices and statutes permitting. Provided,
however, that if any such maintenance, repair or construction is
brought about solely by the neglect or the willful misconduct of one (1)
unit purchaser~ any expenses incidental thereto shall be borne solely
by such wrongdoers.
4. Unless stipulated by agreement, the Purchaser of
any single~family dwelling structure sharing a party wall with the
adjoining structure shall not possess the right to cut windows or other
openings in the part~~ K~all, r~or make any alterations, additions, or
structural changes in the party wall.
5. The purchaser of any such single-family dwelling
structure shall have the right to the full use of said party wall for what~
evei• puiposes said purchaser chooses to employ, subject to the Iimi~
tation that such use shall not infrin e on the ri hts of the urchaser of

an adjoining structure or his ~njoyment of said wall, or of the adjoining
structure, or in any manner impair the value of said structure or ~~all.
~ 6, Each common wall to be constructed on the above-

described lots is to be and remain a party wall for the perpetual use ~
