THL~ DECLARATION, made this L~day of August, 1971, by
BEACH CI.~.'B~COLONY OF STLTART, INC. ~ a Fiorida corporation,
liereby~ states as follcws:
1. That Declarant~ BEACH CLUB COLONY OF STUART~
INC. , a Florida corporation, is the owner in fee simple of certain lots
in BEACH CLL'B COLONY, SECTION ONE, situate and being in the
County of St. Lucie, State of Flc~rida, according to the plat thereof,
filed '~lay 13, 1971 and recorded in Plat Book 16, page 11, St. Lucie
Count~~, Florida, public records. Declarant is constructing upon each
of said lots two (2) single~family dwelling structures connected by a
conimon wall. Each such structure is designed to be occupied solely
by a single family living independently of all others, but will share a
common K~all with the adjoining structure.

~ 2. The cammon wall shared by the two (2) single--
familti dwelling structures, will be located on an imaginary line di,viding
each of the aforesaid lds into tK~o (2) separate, distinct and approximately
equa3 parcels, as more particularly described in Exhibit "A", which is
atiached hereto and made a part hereof, and shall be a party wall for
~ the perpetual benefit of and use by the purchaser, including the heirs,

~ assigns, successors and grantees, of each such single-family dwelling
