owner to comply with the restriction herein provided, then and in any - :

such event the Grantor, his heirs, legal representatives, successors '

and assigns, z~.ay enter upon.the property and undertake to perform ~
such maintenance (including, but not limited to, cutting, clearing,
weeding and cultivating the lawn). Any cost or expense incurred by
the Grantor, his heirs, legal representatives, successors and assigns,
in any such undertaking shall be repaid by the owner, together with
intere~t at the rate of seven per centum per annum, and may be
secured by a lien against the owner's parcel of property enforceable ~

in the same manner, and to the same extent, as is ~rovided for ;
mechanics' or materialmen's Iiens under Florida Statutes as now in
force or as hereafter amended.
5. The Grantor, his heirs~ legal representatives, successors
and assigns, may assign the enforcement provisions of these
restrictions, or any of them, to an association of the owners of parcels
withinBEACH CI.UBCOLO~IY, SECTION ONE, to be formed hereafter.
6. The restricfions provided herein shall be real covenants and
` run with the land. E~cept as otherwis e provided herein, in cas e~he

Grantee, his, her or their heirs, legal representatives, successors 4

or assign8 shail violate or fail to carry out any or all of the stipulated
~ conditions as provided herein, proceedirigs to enforce comptiance there-
with by injunction or other suit or otherwise may be brought, at the
option of the Grantor or his assi~ns. Any owner of other Iots or parcels
bought subject to these same restrictions may proceed similarly. No
fai:ure or omission to bring such suit or take s~xch other proceedingd as
may be deemed necessary shall be heldto be a waiver of any right in the

7. The terms "Grantee" and "Owner", as ~ased herein, shall
