such event the Grantor, his heirs, legal representatives, successors t
and assigns, may enter upon the property and undertake to perforYn
such maintenance (including, but not limited to, cutting, clearing,

weeding and cultivating the lawn). Any cost or expense incurred by ~ ~
the Grantor, his heirs, legal representatives, successors and assigns,
in any such undertaking shall be repaid by the ow~er, together with
interest at the rate of seven per centum per annurn, and may be
secured by a lien against the owner's parcel of property enforceabte
in the same manner, and to the same extent, as is provided for
mechanics' or materialmen's liens under Florida Statutes as now in

5. The Grantor, his heirs, legal representatives, successors

and assigns, may aseign the enforcement provisions oi these
restrictions, or any of them, to an association of the owners of parcels
withinBEACH CLUBCOLONY, SECTION O1~E, to be formed hereafter.
6. The restrictions provided herein shall be real covenants and

Grantee, his, her or their heirs, legal representatives, successors " ~
or assigns shall violate or fail to carry out any or all of the stipulated
conditions as provided herein, proceedings to enforce compliance there~
with by injunction or other suit or otherwise may be brought, at the
option of the Grantor or his assigns. Any owner of other lots or parcels

bought subject to these same restrictions may proceed similarly. 1~To
failure or omission to bring such suit or take such other proceedings as
may be deemed necessary shall be heldto be a waiver of any right in the
Grantor or any lot or parcel owner to enforce compliance with thes e }

- The terms "Grantee" and "Owner", as used herein, shall
