THIS DECLARATION, made this 27th day of August , ~
1971, by BEACH CLUB COLONY OF STUART, INC.. a Florida
corporation~ hereby states as follows;
1. That Declarant, BEACH CLL'B COLONY OF STUART,
INC. , a Florida corporation, is the owner in fee simple of certain lots
in BEACH ELUB COLONY, SECTION ONE, situate and being in the
C~unty of St. Lucie, State of Florida, according to the plat thereof,
filed l~iay 13, 1971 and recorded in Plat Book 16, page 11, St. Lucie
County, Florida, public records. Declarant is constructing upon each
of said lots two (2) ~ingle~family d~velling structures connected by a
con:mon ~~all. Each such structure is designed to be occupied solely
by a single family living independently of all others, but will share a
common wall with the adjoining structure.
2. The common wall shared by the two (2) single~

I family dwelling structures, will be located on an imaginary line dividing

~ each of the aforesaid lots into two ( 2) separate, distinct and approxi~
mately equal parcels, as more particularly described in Exhibit "A",
ti~hich is attached hereto and made a part hereof, and shall be a party
~~all for the perpetual benefit of and use by thepiirchaser, inclu~iing the
hei'rs, assigns, successors and grantees, of each such single~family
d~elling structure.

' desirable to perform maintenance upon, to repair or to rebuild the whole
