The lands lying Westerl~ of the lands which were released at the time of closing, including all or any submerged lands, may be released upon payment of the balance due on the mortgage. 2. Should the State of Florida require the reconveyance to it of the submerged lands included in said mortgage in order to permit the full and unrestricted useo of the uplands as shown on the survey of said lands by Stafford and Brock, F~gineers and Surveyors of Stuart, Florida, dated March 22, 1958, then and in such event the mortqagee, her heirs or assigns, will release such portions and amounts of submerged land from the lien of this mortgage for the purpose of reconveyance to the Sta.te of Florida without any pa.yment by the mortgaqor, his heirs or assigns, Mortgar~o~~ his heirs or assigns, shall execute a mortgage modifica.tion agreemen~ or suc~i other documents as may be necessaxy to encumbe~ any lands, permits, convey- ar~ces or other rights granted to him by the State of Florida. 3. All payments made on the principal of this mortgage shall apply toward partial releases whether requested at the time of said payment or not. 4. Mortgagor shall bear the expenses of preparatior~ and filing all partial releases. 5. .All payments of partial releases shall apply towaxd the next principal payments becoming due under the mort~gage. ~ 6. The A~fortgagee, her heirs and assigns, agree to consent to a ~ subdivision of the premises lying Westerly of Sta,te Road A-1-A, conforming ! with the subdivision requirements of St. Lucie Countq, Florida; provided ; such consent sha11 be without liability, continqent or atherwise, to the ° Mortgagee, her heirs or assigns, and Mortgagee, her heirs or assigns ~ shall have the right to approve 3ny bond Qr other security required for plattinq prior to completior~ of improvements, which consent shall not be unreasonably ~ withheld.
