If at any time during the course of such contest proceed- ings it shall appear to the Leasor that the amount deposited by ~he Lessee i$ or may be insufPicient to pay in full the amount o~' the tax and assessment, together with all interest, penalties and other chargea which may be incurr~d by reason of the contest proceedings, or if at the termination of such proceedings it ahall or may appear that.the amount deposited by the Lessee is in- sufficient to pay in full the amount found to be due, the Lessor shall have the right to require the Lessee to deposit such addi- tional sums as the Lessor may reasonably request, and upon fail- ure of the Lessee to do so within thirty (30) days of demand therefor the amount theretofore deposited with the Lessor may be ~ applied to the payment, removal and discharge of ar~r then pending and contested tax or assessment, and any delinquency ahall be treated as unpaid rent. The Lessor, at the Lessee~s sole expense, shall ~oin in any such proceedings iP any Iaw ahall so require. ~ d. The Lessee may, i~ it shall so desire, endeavor a~ any time to contest the validity of any as$essment, or to obtain a lowering of the assessed valuation upon the Demised Premiaes for the purpose of reducing any assessment. In such event the Lessor will offer no ob~ection and at the request of the Lessee, without expense to the Lessor, will cooperate with the Lessee. If re- quested by the Lessee, and provided he will not in the reasonable ~udgment of the Lessor incur ar~y expense or liability the~eby, ~ the Lessor will execute any documenta which may be necessary and proper Por any such proceedings. Any reflinde shall be the prop- erty of the Lessee to the extent to which it may be based on a payment of an assessment made by the Lessee. e. The Lesao r may at any time require the Lessee to depos- it fur~ds for the payment oP current taxes and asaessments on trie Demised Prem3ses in a bank or trust compar~y selected by the I,~s- sor. Such funds shall be held in the name oP the Lessee, with any intereat payable to the Leasee, but the depositary shall be prohibited Prom paying such funds to ar~yone other than the appro- priate taxing authority except upon the written consent of the Lessor. The Lessee ahall so deposit one-twelfth (1/12) of the current annual taxes, or those of the precedirig tax year if the current taaces have not then been Pi~ced, on the first day of each month in advance, except that all additional funds required Por i - any payment shall also be deposited on the first day of the final month during which or at the end of which a payment is due ar~d payable without interest or penalty, and during which the maxi- mum discount Por early payment is allowable under the law. Insurance Premiums and Utilities.
