lhereinafter called the Gmwer), and TROPICANA PRODUCTS, IIhC. OF HRADENTON, FLORIDA, Buyer 3345~
WITNESSETH:
That the Grower, for and in consideration of the payments received and to be received, as hereinatter recited, has
agreed and does hereby agree to selt to the Buyer a11 citrus fruit of good wholesome, merchantable and marketable
quality trom the grove or groves hereinatter mentioned. The price to be paid and the fruit to be purchased, ail o! which
truit u to be of good wholesome, merchantable and marketable quality, as follows;

All fruit contracted to be pur~hased shaIl be picked as and when Buyer is ready, the picking to be completed on or

~ c~r shipping the same within said period by Act of God, strikes, railraad or other embargoes, quarantine or any other

r c~~ndition, matter or thinR, beyond its control, in which case the time for Raihering and shipping said fruit shall ~e ex-
x t~•nded a lenRth of time equal to ihe period oi the hampering or prevention caused as aforesaid.
Without limiting meanin~ of "Qooci K•holesome, merchantable and marketable" it is a~reed that in event of substantial
~ damage by wealher, such as frost or ireezinR, wind, drouqht, hail etc. the Bu3•er may elect to abandon this contract which
y shall be done by registered mail mailed not later than tourleen days aiter the termination of the weather condition
~ which caused the damaRe, sent to address given betow whereupon Auyer shall be entitled to immediate refund of advance ;

such truit as he shall consider useable, pro~ ided Buyer pays for it in accordance with the terms of this conLract.

If the value of the good wholesome, merchantable and marketable iruit available has not equalled the amount paid
~ by the Buyer at the conclusion of the season provided for herein, the overage immediately will be returned by the
Grower to the Buyer.
Seaer warraats good title to said fruit with lawful right to enter into this rnntract and warrants that it will be free }
of all liens an.t r3aims. The ind.ividuals siAning this aRreement on behali ot Grower represent that they have authority ~
