Sublease, it being agreed that this Mortgage shall not constitute security for the payment of said Note so long as said Note is heid by the bank named therein as payee, but shall secure the payment of said Note only in the event said Note is purchased by Mortgagee. ' In case of default in any of the foregoing covenants and agreemertts, or in case of defauli in the payment by Mortgagors to Mortgagee of any sum the payment of which is secured hereby, Mortgagors hereby authorize ancJ empower Mortgages, its successors and assigns, to foreclose this mortgage by judicial proceedi~gs, or to selt said premises at public auction, and convey the same to the purchaser in fee simple~ , ~ in accordance with the statutes of the State in which the aforesaid premises are situated, and out of the ~ moneys arising from such sale, to retain all sums secured hereby. with interest and all legal costs and charges of wch foreclosure a~d the maximum attorneys' fees permitted by law, which costs, charges and fees e Mortgagors agree to pay, remitting the wrpius, if any, to Martgagors. a ~ No security now held, or in the future to be held, for the payment of any of the indebiedness hereby ~ se~:ured shall be in any way affected, lessened or diminished by the execution of this instrument. All rights, ~ titles, liens or equities held under and by virtue of this mortgage or by other instruments in law or in equity ~ shall be considered as cumulative and not exclusive, Mortgagee shall have the right to proceed under any of ~ ~ ~ the rights held by it without affecting any other right, and election to proceed upon one right or remedy shall not affect any othe~ right or ~emedy, but Mortgagee shaN have the right to exhaust a!I rights and remedies, jointty or separately, until aN indebtedness owing here;r^~r has been fully paid.
