P E R M I T .
THIS PERMIT, executed and issued this day of
, 1971, by the Fort Pierce Farms Drainage District,
pu ic corporation of the State of Florida, hereinafter called~
the District, to Jayhawk Groves of Florida, Inc., a Florida
corporation, and John S. Kearns and Robert B, McCarthy, individually,
hereinafter called the Landowners;
WITNESSETH THAT:
WHEREAS, on March 15, 1965, by motion dul~ made, seconded
and unanimously carried, the Board of Supervisors of the District
committed itself to the issuance of a permit to the Landowners
for the purposes hereinafter set forth;
WHEREAS, a permit was prepared and executed shortly there-
after by the District but was inadvertently misplaced by the
Landowners prior to its being recorded in the public records of
St. Lucie County, Florida; ,
WhEREAS, the Landowners have requested for their further
protection that a duglicate permit be issued by the District in
recordable form; and .
t~REAS, it is the policy of the District to co-operate
with landowners within its designated area to every possible extent;
NOW, THEREFORE, in consideration of the premises above
g set forth, the District does hereby grant permission unto the
~ Landowners, their heirs, personal representatives, successors
and assigns, their agents and servants, and any other person or
persons for their benefit and advantage, in common with the
~ District and other persons, at all times freely, at their own
risk, to use for road purposes the North berm of Lateral #18 of th~
- District Wzst of Johnson Road, and make and lay a roadway thereover,
or otherwise to repair said way as there shall be occasion;
PROVIDED, HOWEVER, that use thereof shall not in any manner
whatsoever interfere with, impede or hamper the District in the
operation, maintenance or widening of their canal.
