Personally appeared before me the undersigned authority i

authorized to administer oaths, B, E. ALDERMAN, JR., who after being i

duly sworn, deposes and says: ~
1. That he is the same person as BURGESS E. A:,DERMAN, JR, i
who acquired title to all of Section 19, Township 34 South, Range 37
East, St. Lucie County, by virtue of that certain Warranty Deed from
T.'A. CLARKE COMPANY, dated November 25, 1940 and recorded December 2, ~

1940 in Deed Book 96, Page 540, of the Public Reco~~~ of St. Lucie
County, Florida; said Section 19 having been subsequently conveyed by
' him, joine~ by his wife, FRANCES ALDERMAN to B, E. ALDERMAN RANCH, INC.,

a Florida Corporation, bl virtue of that certain Warranty Deed dated ~

December 9, 1968 and recorded December 10, 1968 in Official Record

~ Book 174, Page 2354 of the Public Records of St. Lucie County, Florida. ;

~ 2. That at the time said Section 19 was originally purchased f

~ by affiant, and for many years before, excess water from said Section
~
~
~ 19, and other lands lying to the West and South of said Section 19, ~
$ naturally drained across certain lands lying to the North and East of

` said Section 19. This natural drainage continued unimpeded until about
~
1950 when L. W. SCOTT the then owner of all of Sections 20, 18, 17, 8
~ and 5, Township 34 South, Range 37 East, and other lands, constructed
~

a dike around the perimeter of his lands, thereby blocking the natural
3 flow of excess water from said Section 19, and other lands, owned by
affiant. To allow for the drainage of excess waters Tr~m Gaid Section

= 19, and other lands, affiant and others constructed a canal which runs
in a generally Easterly direction across the Southern portior. cf said ~
:3 Section 17, and then in a generally Notherly direction across the '
- Easterly portions of said Sections 17, 8 and 5 to its termination into
