Since the construction of said canal it has been used by affiant and his successor in title for the ~?rainage of excess water from said Section 19, and other lands, and the use of said canal by affiant and his successor in title has been open, notorious, continuous, adverse and under claim of right, for more than 20 years prior to the date of this Affidavit. 3. From the time affiant acquired title to said Section 19, in 1940, until about 1950, excess water from said Section 19, and other lands, naturally drained across said Sections 20, 18, 17, 8 and 5 and other lands. That since the natural flow of water across these Sections was blocked about 1950 by the dike referred to above, said waters have i drained through the canal also refer:ed to above. That since 1950, ~ I 's ~ affiant and his successor in title, B.E. ALDERMAN RANCH, INC., have ~ ~ claimed and do hereby claim to own a permanent an~ perpetual easement ~ x ~ for the drainage of water through the existing canal which runs in a ~ ~ ~ generally Easterly direction across the Southern portion of said Section ~ _ a ~ ~ 17, and then in a gener~lly Northerly direction across the Easterly ~ portions of said Sections 17, 8 and 5 its terminatian into the canal ~ Iocated on the South side of the Sunshine State Parkway, including the 'i ~ right of reasonable ingress and egress along said canal for the purposes C ~ of inspecting and maintaining said canal. ~ Dated this day of November, 1971. , ~ ; - B. .
