8.1 Proviso. Provided, however, that no amendment shall
discriminate againat any condominium unit oNner nor against any
condominium unit or claas or group of unita unless the cor~dominium

unit oxners ao affected ahall consent. No amendment shall be ~

made that ia in conflict xith the Articles oP Incorporation or
the Declaration of Condominium. i
8.2 Execution and recording. A copy of each amendment shall
be attached to a certiPicate certil'ying that the amendment Nas
duly adopted as an amendment of the Declaration ar~d By-La~?s, Nhich '
certificate ahall be executed by the officers of the Association
Nith the formalities of a deed. The amendment shall be effective
when suc~ certificate and cop~r of the amendment are recorded in
~ the Public Records oP St. Lucie County, Florida.
~ 9. Management Agreement. Simultaneously xith the adoption of
s these By-Laxs, the Asaociation, by and through its original Hoard of

~ Directors and Officers, has entered into an agreement xith RECAP

~ MANAGEMENT CORPORATION, a Florida corporation. Each apartment oMner,

- his heirs, successors and assigns, shall be bound by said Management
~ Agreement to the snme extent and efPect as if they had executed said

r~ Management Agreement for the purposes therein expresaed. It is
~
apecifically recognized that some or all of the persons comprising
k the original Board of Directora and OfPicers oP the Association are
~
~
~ owners of some or all oP the stock of the said Management Compar~y,
~
and that such circumstances shall not be construed or conaide~ed as ;

" a breach oP their duties and obligations to the Association, nor as
t grounds Por the invalidation of the Management Agreement in Mhole
~
_ or in part.
- The foregoing Nere adopted as the By- LaNS of COLONNADES
- CONDOMINIUMS ASSOCIATION N0. 5, INC. a corporation not for profit
under the laNS of the State oP Florida, at the Pirst meeting of the
Board of Directora on the 26thday of October , 1971.
