For all purposes hereof, completion of any portion of the subject ~inprovements shall be deemed to mean "substantial completioa" and thus shail r.ot be aeemed to include completion of minor items of construction or so-called "punch list" items which shall not interfere with Lessee's ~ene~icial use and occupancy of the warehouse portion, or subsequently the entire dernised premises, as t:~e case ~ray be, provided, howeroer, that any such minor iteir~s or punch list items shall be fully completEd by Lessor within a reasonable time after the taking of possession by :.assee, subject to Lessor's aqreement to obtain a Certificate of Occupar. fro.;~ tne Gity of Fort Pierce after Lessee's taking of possession, co 've ~brained within a reasonable time thereafter but not to exceen t:~irty (30) days. Section 302. Lessor shall diligently proceed with such construc- i ; tion and shall complete same and deliver possession thereof to Lessee- _ ; _ ~ ~ 4:ithin eight (8)months hereof provided, however, if construction is ~ deiayed because of delay in securing a building permit, failure of ~ E ~ Lessee to approve the plans and specifications, changes in construction ~ ? reruested by Lessee, strikes, lockouts, acts of God or the public enemy, ~ ~ ~ ~ governmental restrictions, unavailability of materials or other matters 3 ~ beyond the control of Lessor, then the time of completion of such con- ~ ~ struction shall be extended for the additional time caused by such delay. ~ ~i ~ Taking of possession of total buildinq by Lessee shall be deemed con- J • ;q ciusively to establish that the demised premises have been completed in accordance with plans and specifications free and clear of all off- = sets and claims against Lessor.
