certifica~e shall be executed by the officers of the Aasociation
rrith the formalities of a deed. The anrendment shall be effective i

9. Management Agreement. Simultaneously Mith the adoption of
these By-LaMS, the Aasociation, by and through ita original Board of

Directora and OPficera, haa entered into an agreement Mith RECAP

~ MANAGEMENT CORPORATION, a Florida corporation. Each apartment oxner, i

~ hia heirs, successora and assigns, ahall be bound by said Management

~ Agreement to the aame extent and ePfect as if they had executed aaid

~ Mana.gement Agreement for the purposes therein expressed. It ia

q apeciPically recognized that aome or all of the persons comprising

the original Board of Directors and OPficers oP the Asaociation are

oMnera of some or all of the atock of the said Management Company,

~ and that such circumatancea ahall not be construed or considered as

~ a breach oP their duties and obligations to the Association, nor aa ~

~ grounds for the invalidation of the Management Agreement in Mhole
