24. Upon the request of the Mortgagor, Mortqagee F

of public roadways or other areas, public utility easements,

zoning applications and restrictions with the applicable i
governmental authorities regarding development of the property
pursuant to plans approved by such governmental authorities,
provided such instruments, and the activities c~ntemplated ~

under them, in the opinion of the Mortqagee, will not
adversely impair the fair market value of the remaininq

; Mortgaged Premises. Such joinder by Mortgaqee will acknowledge

€ that the lien of this t•tortqage is subordinate and subject in

~ all respects to such instruments. Such joinder will not be

~ deemed or construed as rendering the Mortgagee liable for

~ the paving of any streets nor for any other development `
~ obliqations assumed by the Mortgaqor in connection with any

~ such instrument, and the Mortgagee shall not be liable to

~ anyone, including governmental bodies, by reason of its ~

ever be sought or obtained against the Mortgagor or its
