per annum. The prov~sion~ af this Section 9 shall not prevent
any default in the observance of any covenants contained

10. The Mortgagor will not commit or permit any
strip, excavation, erosion or waste or deterioration of the
Mortgaged Premises, whether in connection with construction ~

or otherwise, without the written consent of Mortgagee. ~

11. The Mortgagor, immediately upon obtaining
knowledge of the institution of ariy proceedings for the
conder.nnation of the Mortgaged Premises or any portion thereof,

wi~l notify the Mortgagee of the pendency of such proceedings.

the Mortgagor from time to time will deliver to the Mortgagee all
instruments requested by him to permit such participation. E

In the event of such condemnation proceedings, the award or '
compensation payable is hereby assigned to and shall be '
paid to the Mortgaqee. The Mortgagee shall be under no
abligation to question the amount of any such award or com-
pensation and may accept the same in the amount in which the
same shall be paid. In any such condemnation proceedings
the Mortgagee may be repzesented by counsel selected by the
Mortgagee at Mortgagor's expense. The proceeds of any award
or compensation so received shall be paid to Mortgagee and
applied toward the payment of the principal balance and accrued
interest of the Note.
